Exemption from criminal liability due to the loss of person‘s or criminal offence‘s dangerousness: theoretical and practical problems

The Criminal code of the Republic of Lithuania provides for two types of legal consequences: 1) criminal liability and 2) exemption from it. As can be seen, the criminal liability is not the only way to seek the implementation of the purposes of criminal law. In order to implement the principles of justice, humanity, individualisation of liability, chance and other ones there is a possiblity of exempting a person from criminal liability. In this scientific work is analyzed one type of the exemption from criminal liability – due to the loss of person‘s or criminal offence‘s dangerousness. First of all, there is discussed the general concept of exemption from criminal liability in connection with the perception of criminal liability. Then the focus is on the concept of the exemption from criminal liability due to the person‘s or criminal offence‘s dangerousness both in the criminal law of the Republic of Lithuania and foreign countries.

The implementation of this type of the exemption from criminal liability is associated with specific conditions that do not have any other type of this institute of criminal law: 1) the loss of person’s or criminal offence’s dangerousness 2) due to the change of circumstances. The main focus of work is precisely to analyze these conditions and reveal their essence. In this work is discussed the meaning of the criminal offence’s and person’s dangerousness, as well as the circumstances, which affect that loss of dangerousness. In order to achieve all goals, in this work is discussed not only ideas expressed in the criminal law theory, but an overview of the Lithuanian courts practice is done as well. In addition to this, in this work is analyzed the connection of this type of the exemption form criminal liability with other intitutes of criminal law, revealed their similarities and differences from each other. Finally, the author of this work provides guidance on how to improve the Criminal code of the Republic of Lithuania, exactly Article 36, which provides for that type of the exemption from criminal liability.
