Still one of the biggest problems in the European Union politics is the absence of common refuge policy, therefore now the EU is actively reaching to harmonise it in the member countries. This work raise an objectives to ascertain in what level is the harmonising of common European Union refuge policy in Lithuania now? What does it give to Lithuania? The object of this paper is the coherence between Lithuania‘s refuge policy and common European Union refuge policy.
The purpose of work is to evaluate the coherence between Lithuania‘s refuge policy and common European Union refuge policy. The paper also seeks: (1) to scrutinize the refuge policy’s law base of the EU and Republic of Lithuania as well as to estimate the level of common the EU rules of law transposition into Lithuania’s law; (2) to analize what are the main problematic aspects of transposition the common EU rules of law into Lithuania’s law; (3) to review the activity of governmental and non-govermental institutions, that pursue the refugee policy, and to estimate the level of common European Union refugee harmonisation in Lithuania‘s institutions; (4) to ascertain what implements does EU use to harmonise the common refuge policy in Lithuania; (5) to find how common EU refugee policy influences the Lithuania‘s refuge policy, what changes it causes; (6) to analize how the experts, who are associated with refuge policy, assess the practice of the Republic of Lithuania while harmonising a common European Union refuge policy.
In this paper the qualitative and quantitative methods of analysis were applied. The analysis of Lithuanian and European Union law, regulating refugee policy, was performed; quantitative analysis of statistical data with purpose to identify the community of foreign refugees in Lithuania and in EU was also accomplished. The most important in this paper is the comparative method, it was used to reach the aim of this work: juridical, institutional and social aspects of common EU refuge policy and Lithuanias refuge policy were compared. All of these issues were illustrated using qualitative structurated interview with experts who work with refuge policy.
When the analysis is done, it can be stated that Lithuania‘s achievements of harmonising common European union refuge policy can be assessed as high: majority of common EU rules of law is transposed to Lithuania’s law, the level of common European Union refugee harmonisation in Lithuania‘s institutions also can be stated as high, however the harmonization of common EU refuge policy is not finished yet. Harmonisation has influenced positive changes – the conditions of the asylum seekers acceptance was improved, they are not being send from one country to other.
